Isn't winning an ebay auction a legally binding contract?...so if you wanted to you can bring a lawsuit against them for breach of contract...but I'm sure the money spent may far outway the value of the item so if it is done it would be for the principle of it. Perhaps you could have a lawyer-friend draft you up a nice little letter...especially since there was a payment transaction.
I can feel your pain...I only like to use eBay for stuff I can't find anywhere else or get a wild hair up my ass to buy something I just find there...I was on a pretty good role with ebay for about 6 years with no issues, but in the last 2 years I have had NUMEROUS BAD eBay issues with little help from them. Hope you end up getting the suit!

Time to send them the following notification:
"You can either send me the (fire)suit or I can send you the (law)suit. The former will be far cheaper for you than the latter." |

I don't think this will "hold water" as a legally binding contract.. I think Erik would be wasting his time and expensive money attempting to sue the seller over this.. I would just let it go and chalk it up as a bad experience. It is obvious what crap the seller has pulled here and hopefully e-bay will somehow discipline her over it.. Hopefully he got his money refunded. If not I would pursue it through e-bay agressively..

As I read the ad, I have a few concerns. Yes, Don was married to Patti, but less then 18 years. At the time of Don's death, they were divorced, which is why Terri and Lynn, Don's daughters, inherited everything, not Patti. Last, but not least, the jackets look pretty bare of any patches, tags, etc, that adorned all of the jackets and suits I have seen of Don's.
They could be legit, but I would want want more then a few documents, (I am assuming unrelated to the suits), as proof the suits are legit.
