He states that it has the tank sticker. Like I said this guy is a liar and jerk. Who knows what to believe. As far as I am concerned, the car should be inn my garage bu now. Any suggestions on how to make this sale stand up. Am I at the mercy of a small and petty businessman. I guess all my ranting has not done anything because this jerk still won't respond to me. I guess you can't hurt a mans pride if he doesn't have any. JOESVETT should be remembered by all as someone who does not live up to agreements.

If you are really intent on getting the car, you can find whatever type of "Small Claims" equiv that they have where he lives. Usually, for a small fee, you can file a lawsuit (Here, it is $85 for a 3500 max claim, or $350 for a 10,000 claim). The best part is that you do not need a lawyer, although you can use one if you wish. Here in Louisiana, a Judge hears the claim, in a regular non lawyer discussion, he (the "judge") then does some legal research and renders a legal decision.
Sometimes just the threat or even getting "served" is enough to make a person "make it right".

Caution though, you can be "counter sued" so make sure that your nose is clean!

Thanks for the concern by all. I have already filed with square trade. I don't know what this guy could counter with against me. All I did was email and call him multiple times. I guess I will look into small claims. I appreciate any and all help in this matter.

Get a hold of eBay support and let them know the details!
I doubt they will do anything as they are notorious for
their lack of follow-up when actual problems occur. But,
if you really want the car and the auction ended fairly,
force the idiot to sell you the car. That is how you win
these things and get these sellers to go away.

Hey,
I just wanted to fill everyone in on my progress or lack there of with Joe T*****. Apparently he agreed with square trade to discuss this matter with me and then as usual he changed his mind. This guy is a real piece of work. he still won't take my calls. I will call him daily until he gets a sack and picks up the phone. Does anyone have any suggestions? Please be careful. Joe T***** in Lake Carmel, NY is a very untrusty person. The problem is that I know where the car is and have every intention of seeing this deal through.

I would just let it go. you cant make somebody sell you their car,even i know you won it at auction. I dont think theres a court in the land that would make him sell it to you. JMO but i would move on.

Hey Don not true..he has a binding contract to buy the car at the selling price..and how it was stated in the add not destroyed or anything...the hassle is the buyer needs to be present in court or have a Attorney present at court where the lawsuit is filed...the kicker is even in small claims I am told if the guy cannot or will not produce the item being sued over..the winner gets restitution on the actual value of said item even if it is 10 times what the original selling price is...at least thats how it was exsplained to me how it works in the Sate of Wa.

a person must weigh how much hassle it it worth????.
