While the situation for application of deadly force is much better than north of the border...there are certain states [as Rick pointed out] that tend to side with the bad guys.

In New York we have a duty to retreat outside of the home...in your home it is different, but you still need to show great restraint before acting. Basically exhaust all possible options. Our penal law section #35 deals with this topic and is required training for any new CCW application.
