"We conclude, under the plain language of MCL257.1307a, that defendants “performed” a tire rotation, albeit negligently...There is no support for the trial court’s determination that a tire rotation is not “performed” if a service person fails to sufficiently tighten the lug nuts on one tire."

The court is not saying that it was "OK" for the Mechanic/shop not to tighten/torque the lug nuts......only that the particular law applies mainly to worked charged which was not done and this is not the case here.

Of course the Mechanic/shop were negligent and therfore liable by not doing the job properly, but they did indeed do it.
